PREAMBLE: 

These Terms and Conditions govern the access and use of the EHOME5 mobile application (“the Application” or “APP”) provided by CIRCONTROL, S.A. (hereinafter “CIRCONTROL”), intended to manage and control the charger for electric vehicles. By downloading, accessing and using the Application, the user (“you”) accepts and agrees to comply with these Terms and Conditions.

Please read the following terms and conditions carefully before using our Application. Access to and use of said APP implies acceptance and compliance with these terms.

  1. Who we are

  • Acceptance of Terms:

By accessing and using this Application, you agree to comply with these terms and conditions, as well as all applicable laws and regulations.

You are responsible for maintaining the confidentiality of your account and password, and for restricting access to your account. You must immediately notify CIRCONTROL of any unauthorized use of your account.

CIRCONTROL reserves the right to modify these Terms of Use if necessary due to the development of the Application or because new functionalities are implemented.

In the event of non-compliance with these conditions or misconduct by the user, CIRCONTROL reserves the right to prohibit or restrict access to the Application.

The application will send notifications related to its operation, including reminders, updates and important communications. The user will have the option to accept or reject the sending of such notifications from the application or device settings.

You agree that we send you notices and messages through the email provided, as well as through the contact information you have provided to us.

  • Service Description 

The App provides an interface to control and monitor the status of your EV charger. Key features include, but are not limited to:

  • Starting and stopping charging sessions.
  • Monitoring charging progress in real time.
  • Setting up charging schedules.
  • Obtaining information about charging history and statistics.
  • To provide assistance when you request technical support.
  • To provide you with remote maintenance service if you contact your service provider.
  • Use of Location

The App may collect and use location data from the user’s device for the purpose of enabling the start-up and operation of the charger, provided that the user has given his/her consent. The user may revoke this consent at any time by accessing the location permissions from the settings of his/her device and managing them. This data will be used only to ensure the correct provision of the service and in accordance with the provisions of our Privacy Policy.

  • User Requirements

To use the Application, the User must meet the following requirements:

  • Complete the registration form with truthful data, providing the following information:
  • First and last name
  • Email
  • Password
  • Be at least 18 years of age or the age of majority in your jurisdiction.
  • Have a compatible mobile device with internet access.
  • Have access to an electric car charger compatible with the Application.
  • You must have a stable Internet connection
  • Operating WiFi network
  • Intellectual and industrial property:

All content present in this Application, including, but not limited to texts, graphics, logos, images, videos, software and all types of documentation, are the exclusive property of CIRCONTROL.

The User does not acquire any rights over these intellectual/industrial property rights by using the Application.

  • Privacy and Personal Data 

At CIRCONTROL we know how important privacy is for CIRCONTROL customers, you can consult our Privacy Policy at www.circontrol.com.

  •  WiFi Connection and User Responsibility

The User is responsible for ensuring that his/her electric car charger is properly connected to a secure WiFi network. The Company is not responsible for service interruptions due to network connectivity failures.

  • Limitation of Liability

To the maximum extent permitted by applicable law, CIRCONTROL shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages arising from the use or inability to use the Application.

CIRCONTROL is not liable for any misuse of the electric charger by the user or third parties, or for any damages or losses resulting from failure to comply with these Terms and Conditions and technical problems, failures or interruptions in the service that are beyond the control of the Application and its control.

By making this Application available to the user, we want to offer a whole series of quality services and content, with the utmost diligence in the provision of these services and content and in the technological means used. However, although CIRCONTROL has adopted the security measures permitted by the current state of technology, it cannot guarantee the absolute absence of viruses or harmful elements and, consequently, is exonerated from any liability in this regard.

CIRCONTROL reserves the right to temporarily suspend access to the Application for reasons related to the improvement, maintenance or review of the content or programming, and also for any other reason.

  1. Applicable Law

These Terms shall be governed by and construed in accordance with the laws of Spain. In the event of any discrepancy or difference between the parties in relation to the interpretation and content of this website, all parties agree to submit, with express waiver of any other jurisdiction, to the courts and tribunals of Terrassa.
